In compliance with Law 34/2002 on Services of the Information Society and Electronic Commerce (LSSICE), we inform that the ownership of our online store domain,  www.salter.es , corresponds to COMERCIAL SALTER, SA, a company legally incorporated in Spain with tax number CIF A-08544298 and registered with the Mercantile Registry in Barcelona, Volume 3834, Book 3180, Page 40298, Page 187, Section 2, Entry 1 (henceforth salter.es). 2. OBJECT AND SCOPE OF APPLICATION

These general purchase conditions are intended to regulate the provision of information provided in the online store belonging to salter.es, as well as commercial transactions arising between salter.es and users of the domain   www.salter.es . Both navigation using the online store and the acquisition of any of the products offered in it, mean the acceptance as a user, without reservations of any kind, of each and every one of these general conditions of purchase. Salter.es may modify the website to make as many changes and modifications it deems appropriate and necessary to ensure proper functionality, without prior notice.

3. SERVICE AVAILABILITY

Our website is only intended for shipments to the Spanish Peninsula. The delivery of products to the Canary Islands or the Balearic Islands is expressly excluded, as well as any orders for shipments to other countries. If there is interest from the Canary Islands or the Balearic Islands in purchasing products, contact the telephone number 902 40 06 40 or from abroad at 93 470 00 55.

4. INFORMATION PROVIDED ON THE WEBSITE

In the case that at some point there was an error of typographical type, at all times oblivious to the will of  www.salter.es , it would be immediately corrected. If there is a substantial typographical error in any of the prices shown which supposes a price significantly lower than the product’s usual price, and a customer has made a purchase decision based on that error, we will communicate this error and the customer will be entitled to rescind their purchase without incurring any costs. Sending an automatic purchase confirmation does not validate the wrong price conditions.
In the same way, it is possible that the contents of the website may show, on occasion, provisional information about some products. Should the information provided not correspond to the product’s characteristics, the customer will have the right to rescind their purchase without incurring any costs. The published images are not required to correspond to the products sold, as these are merely indicative, while the description of the product in question is binding, according to the current legal regulations.

5. LIABILITY OF SALTER.ES

The products presented on the website are in accordance with Spanish legislation.
Access to the website will be voluntary, and, therefore the responsibility of the user, who will be responsible for any direct or indirect effect derived from the use of the website, including, without limitation, any economic, technical and / or adverse legal result, as well as any appreciation of disappointment in the expectations generated by our website, and the user is thus obliged to keep salter.es harmless for any claims deriving, whether directly or indirectly, from such facts. Salter.es is not liable for damages that may arise from interferences, omissions, interruptions, computer viruses, breakdowns and / or disconnections in the operational functioning of this electronic system or in users’ computers and equipment, motivated by causes that are nothing to do with Salter.es, that prevent or delay the provision of services or store browsing, or delays or blockages in use caused by Internet deficiencies or overloads or other electronic systems, or the impossibility of providing the service or allowing access for reasons not attributable to salter.es, due to the user, to third parties, or due to cases of force majeure. Salter.es does not control, in general, the use that users make of the website.

In particular, salter.es does not respond in any cases wherein users use the website in accordance with the law, with these general conditions, morality, and generally accepted good customs and public order, or when they do so diligently and with prudence.

6. OBLIGATIONS OF CLIENTS AND USERS

In general, the user agrees to comply with these general conditions, as well as to comply with the special warnings or instructions for use contained in the same or on the website and always act in accordance with the law, good customs and the requirements of good faith, using due diligence, and abstaining from using the website in any way that may prevent, damage or deteriorate the normal functioning of the same, the goods or rights of salter.es, its suppliers, of other users or in general of any third party. The access and use of the portal is prohibited for minors without the express consent of their parents. Salter.es is not responsible for the veracity and accuracy of the data supplied by the user and therefore cannot verify their age. Specifically, and without implying any restriction to the previous section during the use of the website  www.salter.es, the user is obliged to:

  1. a) Provide truthful information about the data requested in the user registration form or order fulfillment, and keep them updated.
  2. b) Not introduce, store or disseminate on or from the website, any information or material that is defamatory, libelous, obscene, threatening, xenophobic, incites violence through discrimination based on race, sex, ideology, religion or that in any way violates public moral standards, public order, fundamental rights, public liberties, honor, privacy or image of third parties and in general the current regulations.
  3. c) Do not enter, store or disseminate through the store’s page, any program, data, virus, code, or any other electronic or physical device that is likely to cause damage to the website, any of the services, or any of the equipment, systems or networks belonging to salter.es, or of any other user, salter.es suppliers, or in general of any third party.
  4. d) Diligently save the “username” and the “password” provided by Salter.es, assuming responsibility for any damages that may arise from their improper use.
  5. e) Not carry out advertising or commercial exploitation activities through the website, and not use the contents and information thereof to send advertising, or send messages for any other commercial purpose, or to collect or store personal data of third parties.
  6. f) Not use false identities, or impersonate the identity of others in the use of the website or in the use of any of its services, including the use of third party usernames or passwords or in any other way.
  7. g) Not to destroy, alter, use for own purposes, disable or damage the data, information, programs or electronic documents belonging to Salter.es, its suppliers or third parties.
  8. h) Do not enter, store or disseminate through the store’s page any content that infringes intellectual property rights, industrial or business secrets of third parties, or in general any content which is not commensurate, in accordance with the law, with the right to put it at the disposal of a third party.

The customer agrees to enable the delivery of the requested order by providing a delivery address where the requested order can be delivered within the usual goods delivery schedule. In case of the customer breaching these obligations, salter.es shall not be held responsible for the delay or impossibility of delivery of the order requested by the client.

7. HOW TO PURCHASE

7.1 USER REGISTRATION

To place an order it is necessary to connect to salter.es, register as a user or buy as a guest, filling out the form and following the instructions indicated therein.

7.2 HOW TO FIND AN ARTICLE

To find an article you can use the filters or use the sort criteria.  Once the article is found, you can expand the information by clicking on its name or its image. In this way you can access the product card with the detailed characteristics and price.

7.3 HOW TO ADD AN ITEM TO THE SHOPPING CART

From the product file, click on the ADD TO CART icon to add the item to the shopping cart. Once in the cart, you can continue buying or process the order with the products included. During the purchase, the cart remains visible in the upper right part of the page so that you can remove an item from the cart or modify the units at any time.

7.4 ORDER VALIDATION

After registration, and to proceed with the purchase of the products added to your cart, you must complete the form and validate it. The validation of the order by the customer expressly assumes knowledge and acceptance of the general conditions of purchase.

7.5 FORMS OF PAYMENT

Salter.es offers you different means of payment so you can choose the one that best suits you or best suits your needs:

Payment by Credit Card: You can use Visa, MasterCard, American Express and DinersClub. In the event that the POS informs that the card has been denied, the order will be canceled automatically. As an alternative we propose making payments by bank transfer. For security reasons, salter.es reserves the right not to accept certain transactions made with a credit card. In the event that the cancellation of the order occurs once it has been charged, the amount charged on the original credit card where the charge was made at the time, will be refunded. In these cases and if the client is interested in progressing to purchase the items, they may repeat the order by selecting the bank transfer as a means of payment.

It is very important that in the transfer field CONCEPT the order number given at the end of the order is included. Salter will not ship the order before receiving the transfer.

There is a 2 working days period in which the transfer may be effected after completing the order. The order will not be considered effective until we confirm the corresponding income of funds and, therefore, the delivery terms begin to count from this date.

7.6 ORDER CONFIRMATION

Once the purchase has been made and within the shortest possible time, always before the period of 24 hours since the execution of the purchase elapses, the Customer Service Department of salter.es will send you an e-mail confirming the purchase. If you do not agree with the information entered in this confirmation you can request the modification of the same or the cancellation of the contract. Print or save this email if you wish to query the status of your order.

COMERCIAL SALTER, SA will issue the invoice once the order is shipped from our warehouses and send this by email. COMERCIAL SALTER, SA warns that it will not be able to subsequently modify the sales invoices in compliance with current regulations. The invoice will be issued in the name of the natural person or company that places the order, so the customer must make sure to place the order in the correct name. No subsequent changes will be possible.

8. SHIPPING COSTS

Shipping costs are not included in the price and will be shown to you for express acceptance before finalizing your purchase. The shipping cost varies depending on the delivery mode you choose and the province of destination.

9. ASSEMBLY

Assembly costs are not included in the price.

10. DELIVERY DEADLINES

Salter estimates a maximum period of 10 business days to receive your order. The delivery date will appear in the order confirmation email. In the event that we cannot meet the delivery deadline, our Customer Service Department will contact and notify you and proceed with the confirmation or cancellation of said order.

The transport company will contact you at the telephone number indicated in the order to carry out the delivery of the goods. Before signing the carrier’s delivery agreement, verify that the package/s has/ve not been tampered with, nor received any apparent blows. In case of observing incidents, leave a record on the delivery note of the transport and if you think it necessary, do not accept it.

11. INSURANCE

All the merchandise we send is insured for its total value against loss, theft or damage.

12. PRODUCT AVAILABILITY

Salter has a large stock to offer all items within a maximum period of 10 business days. However, in the event that we cannot meet the delivery deadline, our customer service will contact you to let you know and proceed to confirm or cancel the order.

13. RETURNS

– The maximum period to request a return is 15 calendar days from the reception of the order.

– Before making a return or exchange, you must send us the return form detailed below to the email address  online@salterfitness.es

– Any product that you want to change or return must always be made with its original packaging and labeling and intact, conveniently packaged in its original box and properly protected. The item to be returned must be in the same state in which it was received, which will be determined by our experts.

We differentiate two cases for returns: either you do not like the product or the product sent is damaged or incorrect.

– If the reason for the return is due to a defect or damage to the product or because it does not correspond to the product purchased, Salter will cover the return and forwarding of the goods to the recipient. The transport company will contact you to pick up the goods to be returned.

– If the return is due to personal reasons (you do not like it, it does not feel good or you have changed your mind), you must send the item to the address: COMERCIAL SALTER, S.A. Calle Lluis Millet, 52 08950 Esplugues de Llobregat (Barcelona).  Upon receipt of the package, Salter will confirm the good condition of the product and proceed to refund the amount of the item (s) returned (excluding the expenses of the first shipment), within 10 business days of receipt.

If the goods are rejected by the recipient without stating the reason in the delivery agreement of the carrier, Salter will not be responsible for the costs of the return. In this case, the amount of the item (s) that were returned will be returned, but not the shipping costs.

14. GUARANTEE CONDITIONS

All the SALTER products, with the exception of wear parts*, are guaranteed to customers subject to the following TERMS AND CONDITIONS:

1) The warranty term is 2 years for parts and 1 year for travel and labour costs, effective from the date of purchase indicated on the bill of sale or delivery note if the latter has a later date.

2) The warranty may be executed in all European Union member states.

3) The warranty may be claimed directly from the store selling the product, pursuant to the terms established by current law.

4) To execute this warranty it is necessary to present the bill of sale or delivery note if the latter has a later date.

5) Customers may also claim the warranty directly from the manufacturer, who will respond in the event of lack of compliance and repair or replace the product within the terms and limits stipulated by the law.

6) This warranty refers only to final consumers and is not transferable.

7) The warranty covers repairs or corrections of damages or faults encountered in the equipment which are proved without doubt to correspond to manufacturing or factory faults. All parts which, after checking, have faults in their materials or manufacture will be repaired in accordance with the conditions set forth in the manufacturer’s general conditions of sale. Complete modifications are only possible if this is determined by SALTER’s technical service.

8) This warranty will not apply in the event of failures, faults or damage caused by: a) faults in operation due to negligence; b) incorrect use; c) using the equipment, which is designed for household use, for professional purposes. d) handling of the product by persons not belonging to SALTER’s Technical Service; e) in the event of replacing original parts with others not supplied by the manufacturer; f) adaptations or changes made to enhance the product that alter the characteristics described in the user manual without the previous written consent of the manufacturer; g) external factors such as moisture, sweat, poor environmental conditions, saline or corrosive environments (caused by pools or similar), improper use of chemicals, etc. that could cause damage to paint and chrome plating; h) wear due to normal use of the appliances; i) causes not attributed to the product and arising from failing to heed the recommendations given in the user manual; j) the effects of external agents such as flooding, fire, earthquake, etc.; k) potential damages caused to the products during transport due to causes not attributed to SALTER.

9) This warranty will not apply if the product serial number has been altered, deleted, disappeared or is illegible.

10) The spare parts supplied by the manufacturer and the repairs made are guaranteed for 6 months, provided the installation of these parts is supervised by the manufacturer or by authorized technical staff.

11) SALTER declines all liability for damages caused to people or property as a result of improper use, lack of maintenance, negligence in handling or lack of professional supervision with respect to the articles sold.

12) The manufacturer reserves the right to make repairs in its own technical service workshops or in the customer’s home.

*Wear parts are guaranteed for 6 months (parts, travel and labour costs). The term “Worn parts” refers to all parts, assemblies and components subject to wear due to actions by the user as a result of being handled directly by the user or parts that are handled (such as upholstery, pedals and components, saddles, markers, emergency stops, bands, switches, control panels, etc.)

15. APPLICABLE LEGISLATION. SUBMISSION TO JURISDICTION

The purchases made on www.salter.es are subject to Spanish legislation. In the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, the Courts and Tribunals that, as the case may be, will hear the matter, are those established by the applicable legal regulations in matters of the competent jurisdiction, handling, in the case of the final consumers, legal matters in the place where the obligation is fulfilled or the domicile of the purchasing party.
